Plutope Terms of Use.

Introduction
This Terms of Service ("Agreement") is entered into by and between Plutope, a private limited company incorporated in India ("Company", "we", or "us"), and the user ("User", "you", or "your") accessing and utilising the Wallet/Card Services ("Service"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement. Please read these terms carefully before using the Service.
This Agreement outlines the terms governing your use of our website, mobile applications, and any related content, features, or services. Your use of the Service constitutes your acceptance of and agreement to abide by these terms.
Key definitions
- Service. All products, features, and services provided by the Company, including the creation, management, and use of digital cryptocurrency wallets, secure storage of cryptographic keys, and associated tools and technologies.
- User. Any individual or entity accessing or utilising the Company's Service.
- Crypto Wallet. A digital platform enabling Users to store, manage, send, and receive cryptocurrencies and digital assets. Consists of cryptographic keys — a private key for authorising transactions and a public key for receiving funds.
- Digital Asset. An asset issued and transferred using distributed-ledger or blockchain technology, including virtual currencies, coins, and tokens.
- Fees. Charges applicable to Users for various services, such as transaction fees, storage fees, and service fees, as outlined in the Company's fee schedule.
- Parties. Collectively refers to the Company and the User(s) involved in the Agreement.
- Agreement. This document, including all clauses, terms, conditions, and incorporated policies.
Acceptance of terms
By registering on Plutope, you acknowledge that you have read, understood, and agree to abide by our Terms of Service, Privacy Policy, and any other rules and policies that Plutope may publish from time to time. Failure to comply with these terms may result in the termination of your access to our services.
Our services
Plutope offers a comprehensive range of services tailored to digital-asset holders. Our primary focus is to empower individuals with secure, convenient methods to manage and utilise their digital assets.
Plutope Crypto Wallet. Our feature-rich wallet ensures security, usability, and accessibility for storing a diverse array of cryptocurrencies, including multi-currency support, bank-grade security (encryption, two-factor authentication, and cold-storage solutions), and a user-friendly interface that simplifies tracking, transferring, and monitoring your holdings.
Plutope Visa-Powered Card. Through a strategic collaboration with a trusted third-party partner and the VISA network, Plutope offers a multi-functional digital-asset-enabled VISA card. Features include digital-asset-to-fiat conversion for everyday transactions, global acceptance at millions of VISA-affiliated merchants, contactless payment, integrated VISA security (EMV chip technology, transaction monitoring), international remittance, and ATM cash withdrawals subject to VISA limits.
Conditions for registration
Identity verification. During registration you will be asked to provide information for identity verification. You consent to provide accurate, complete, and updated information about yourself and to keep it current.
Account sharing prohibited. Sharing your Plutope account is strictly prohibited. Your account is intended for your individual use only. You are responsible for all activities under your username.
Security of credentials. You are solely responsible for maintaining the confidentiality of your account. You are fully accountable for any actions, authorised or unauthorised, that occur using your credentials.
Access restriction. Plutope reserves the right to refuse, suspend, or deny access to all or any portion of our services if we believe you have violated our Terms or engaged in inappropriate activities.
Third-party services
- Plutope disclaims responsibility and liability for any third-party service, content, information, or material accessible through our platform.
- The decision to rely on or utilise third-party content or services is entirely at your own discretion and risk.
- Inclusion of third-party services does not constitute an endorsement, sponsorship, or affiliation unless explicitly stated.
- To the fullest extent permitted by law, Plutope shall not be liable for any damages arising from or related to your use of any third-party service or material.
Mobile applications
Apple application. The Apple Application may be accessed and used only on a device owned or controlled by you running iOS. Apple has no obligation to provide support or maintenance services; contact us, not Apple, for support. Apple is a third-party beneficiary entitled to enforce these Terms against you. In the event of any third-party claim that your use of the Apple Application infringes intellectual-property rights, Apple is not responsible. You represent and warrant that you are not located in any country subject to a government embargo or designated as "terrorist supporting", and you are not listed on any government list of prohibited or restricted parties.
Android applications. The Android Application may be accessed and used only on a device owned or controlled by you running Android. Google has no obligation to provide support; contact us, not Google. Google is a third-party beneficiary entitled to enforce these Terms against you. In the event of any third-party claim that your use of the Android Application infringes intellectual-property rights, Google is not responsible. You represent and warrant the same sanctions and embargo conditions as above.
Changes
We may revise and update these Terms and Conditions from time to time at our sole discretion. All changes are effective immediately when posted. Continued use of the Websites and any Services following the posting of revised Terms means you accept the changes.
Plutope reserves the right to change, modify, enhance, or discontinue any or all of the services we offer. We will use commercially reasonable efforts to inform you of any discontinuation via the Plutope website or other public communication channels. It is your responsibility to review this Agreement periodically.
Eligibility
- You must be at least 18 years of age to access and use Plutope's services.
- You represent and warrant that you are legally permitted to use the services under the laws of the country in which you are a resident or from which you access the services.
- Plutope is not liable for any consequences or legal issues arising from your failure to comply with the age restrictions or legal requirements of your jurisdiction.
- If you do not meet the eligibility criteria, you are prohibited from accessing and using Plutope's services and website. Plutope reserves the right to verify your eligibility and take appropriate action.
Sanctions & restricted persons
- None of your officers, managers, directors, shareholders, or authorised representatives is a Restricted Person or Sanctions List Person, or is located in, ordinarily resident in, or organised under the laws of, any Embargoed Jurisdiction, or is owned or controlled, directly or indirectly, by any such person.
- You affirm, represent, and warrant that you are not (a) located, organised, or resident in any country or territory that is subject to comprehensive U.S. trade sanctions, (b) an individual or entity identified on any applicable sanctions list, including the U.S. Department of the Treasury's Specially Designated Nationals and Blocked Persons List, or (c) owned, controlled, or acting on behalf of any person or entity located, organised, or resident in a Sanctioned Country or identified on a Sanctions List.
Trading risks
Plutope provides a wallet service that allows you to securely store, use, sell, or purchase cryptocurrencies. While we offer a secure and convenient platform, there are inherent risks associated with trading and using cryptocurrencies, including cryptocurrency volatility, market risks, lack of regulations, security concerns, technical risks, user responsibility, and loss of funds. By using Plutope's wallet services, you acknowledge and accept these risks. You should only invest or transact with funds you can afford to lose. Plutope shall not be held liable for any losses, damages, or consequences arising from your use of our wallet services or the trading of cryptocurrencies.
Investment advice
Any information provided by Plutope, including articles, guides, analyses, market trends, and insights, is intended for informational purposes only. It does not constitute financial, investment, legal, or tax advice. Plutope does not provide investment recommendations or personalised financial advice. Information is offered without any express or implied warranty of accuracy, completeness, or fitness for any particular purpose. Any decisions you make are at your own risk. Investing in financial markets, including digital assets, involves inherent risks; past performance is not indicative of future results.
Taxes
It is your responsibility to determine what taxes apply to the trades you complete and to report and remit the correct tax to the appropriate tax authority.
Payments, reversals & cancellations
- All payments for Plutope's services must be made exclusively through the payment methods explicitly specified by Plutope.
- Plutope reserves the right to verify the validity of payment methods and to cancel or suspend payments and/or services where a method cannot be verified or is invalid.
- Once an order or transaction has been marked complete by Plutope, it cannot be cancelled, reversed, or modified by the User.
- If the User violates any of these terms, Plutope reserves the right to terminate or suspend access to its services, including the cancellation of any ongoing or pending transactions.
Fees
While Plutope does not charge any fees at present, the company may decide to implement fees for its services at a later date. These could include transaction fees, account maintenance fees, withdrawal fees, or any other charges deemed necessary. Any such fee implementation will be communicated through official channels, including the Plutope website and user notifications.
Communication
- Plutope does not require Users to provide personal information such as email addresses for the purpose of safeguarding identity within the application. All necessary communications will be made available directly through the Plutope application.
- Users can expect notifications, alerts, and messages within the application's interface, including important information, updates, and security notifications.
- Users may voluntarily provide their email address; in that case Plutope may send occasional communications to the provided email, though the primary mode of communication remains in-app.
Copyrights & intellectual property
All copyrights, patents, trademarks, trade secrets, and any other intellectual-property rights associated with Plutope's services, products, designs, content, software, and technologies are and shall remain the sole and exclusive property of Plutope. While using Plutope's services, users are granted a limited, non-exclusive, non-transferable licence to access and use Plutope's intellectual property solely for engaging with the services as intended. This licence does not grant users the right to reproduce, distribute, modify, create derivative works, reverse engineer, or otherwise exploit Plutope's intellectual property without explicit written consent.
Limitation of liability
- Plutope shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or other intangible losses, arising out of or in connection with the use of Plutope's services.
- Plutope shall not be liable for any damages resulting from the actions or omissions of third parties, including other users, service providers, or external entities.
- Plutope shall not be liable for any failure to perform its obligations or any delay or disruption in service due to circumstances beyond its reasonable control.
- Plutope's services are provided on an "AS IS" and "AS AVAILABLE" basis, without any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, or availability.
- Plutope does not warrant the security of your data or transactions on its platform; while we employ security measures, there is no absolute guarantee against unauthorised access or other security incidents.
Indemnification
By using the services provided by Plutope, you agree to indemnify and hold harmless Plutope, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of Plutope's services. This applies to any third-party claims, actions, or demands, and to any violations of these terms or applicable laws.
Discontinuance of services
Plutope retains the right to discontinue, suspend, or terminate any or all of its services, features, or functionalities without prior notice. This may occur for reasons including changes in business strategies, regulatory requirements, technical limitations, or other unforeseen circumstances.
Governing law
This agreement shall be governed by and interpreted in accordance with the laws applicable in India. Any disputes arising from or relating to this agreement shall be subject to the exclusive jurisdiction of the competent courts in India.
